- Chapter 13 is a law under which a debtor prepares a plan and discusses it with the creditors in which the debtor makes out a payment plan in the debtor will pay the entire amount payable to his creditors. This plan could be of three to five years depending upon the negotiation done between the debtors and the creditors. The only thing which can concern a creditor is that a debtor must have a flow of income or the debtor must have a steady income. A trustee can play an important role by helping the debtor in his financial advices and many other things for the benefit of the debtor.
- Interim bankruptcy rule which was effective from October 17th in 2005 says that an individual filing for a waiver for the filing fee must file a form with voluntary petition of the prescribed official form. The court will not extend filing schedule dates for statements and documents amounting to more than 7 days in a calendar. If any case of delay then the petitioner must file it, in which he has to mention all the details like the reason for the delay and the dates of petition, schedule and statements.
