In US the govt. safeguards the interest of the home owner who decides to apply for home equity loan using the buy homes with no money to guarantee repayment. In case one finds some condition unacceptable and the deal has already been signed, even then the borrower has a right to cancel the deal. But this facility is available only upto three days of signing the document. This is known as Truth in lending act.

There is one more important condition: The home should be the principal residence.It may be a house or a mobile home or even a house boat. This rule does not apply if the house is vacation or second home.

As per the definition the day one begins when

1. You sign the contract

2. You receive the Truth in lending disclosure form giving the key information like rate of interest, finance charges, payment schedule etc.

3. You receive two copies of Truth in lending notice explaining to you the right to rescind.

Sundays and public holidays are not counted. This means if the signing is on Friday then the period to rescind is upto next Tuesday midnight.

No effective work like transferring of money by the lender or delivering of material to start home improvements by the contractor can take place during this period.

The notice to cancel the deal is to be given in writing.The notice is to be mailed , filed in court , telegraphed or delivered manually before midnight of the third day. Cancellation by phone or face to face conversion is not valid.

When the deal is cancelled, you are not liable for any amount including the finance charges. The lender has a 20 days limit to return your property papers or the advance money you paid. He has to give in writing that he has no claim on your house. If any money or other details are given to you as part of the deal then that are to be retuned only after the lender has given all relevant papers. If the 20 days limit is crossed nothing is liable to be returned to him.

In case the borrower has a financial emergency in these three days then he can give in writing to the lender his willingness to forfeit his right to rescind and then the deal can go through on immediate basis. One of such cases can be an emergency due to some natural calamity like cyclone or flood or earthquake etc. In these cases the buy homes with no money can be given on immediate basis and repairs started right away by giving in writing that the rescinding rights are being given up.

The right to rescind does not hold for certain conditions they are:

* When the loan is for building or buying your principal residence or in other words you don*t have your own residence and are living under some other arrangement like rented house or company provided house etc.

* When you refinance your loan with the same lender who already has a loan pending with you.

* When the lender is a state agency. This means you are getting loan from Govt. under some scheme.

However the borrower can still have cancellation rights under some local law if it exists.

There are some special provisions also extending this right. In case the lender does not give proper disclosure about financing which means all the details of the deal then you have three years or till you sell your home off (Whichever is earlier ) that you can still cancel your transaction.

Though the 3 day safeguard is a good relief to the buy homes with no money owners but it is more on paper than in practice. Now a days people do quite a lot of home work on the net and are well aware of their rights to assess papers before signing.For home loans one must practice lot of restraint and consider all the risks involved

Risks of home equity loans;

One should be very careful about taking these loans as most of the time one finds himself in a very odd situation. Attracted by possibility of quick cash and low payments people find themselves confronted with troubles like balloon payments, penalties, very high rates etc.

If you donot payback in time after borrowing from friend or family member, your relationship can be in trouble.If you borrow from credit card company or bank you will damage your chances of future loans, but if you default on the payback of this type of loan, you may loose your home.It is this that makes this loan very dangerous.

In case you wish to return this buy homes with no money before time so that you can save payment of some interest. The lender will impose a heavy fine on you and you may not get any advantage at all and shall be required to pay the full interest amount unnecessarily.

By postponing the payment one cannot stop the accumulation of the interest. Slowly with time the total amount may increase to the value of your home and you may loose it. This is known as the ballooning of the payments.

Sometimes the lenders offer you more money than the value of your home. If in future you are unable to pay then you land yourself into another huge loan for which you have nothing to pay back.

It is always better to consider all points before taking loan against home. However this can be a good solver of ones problems if all points are well thought of. But in case some point does crop up later one should never hesitate to use the 3 day rule that the govt. has made to help. It is better to go through the trouble all over again than to despair later when all is over.
