Power of attorney forms

A power of attorney form is used to mandate in civil law, the authorization to act on some person as a legal decision maker on behalf of that person. This kind of enforcement is used in the legal and business operation due to inability of decision making of the original owner due to some reasons. A power of attorney is authorized by the principal or grantor of the power or also called as "principal" and the person to whom it is granted or authorized is called as the agent or also called as the "agent or attorney in fact. A power of attorney is to give the power to make decision to the authorized person due to various reasons that includes long term illness, hospitalization due to accidents and other reasons. A power of attorney is legalized only when it is given in writing to the court or law. There are different kinds of power of attorneys that are for a specified purpose and for those different forms in accord that have to be filled.

Types of power attorney forms

The forms for power of attorneys for different purposes are as follows:

  • Short form- Enduring power of attorneys: this form is for the person who wishes to appoint the power of attorney for financial and personal matters that also includes reasons due to health problems. This form additional can be used to appoint an attorney for the either financial or personal matters. This can be useful for non English speakers who can give authority to the person along with a signed interpreter form attached.
  • Long form- Enduring power of attorney: This is the form that can be used by the person to appoint the power of attorney for personal matters and by the same time to appoint a different power of attorney for financial matters. This document can be only used if a person wants to use grant power of financial matters and legal matters to a different persons.
  • Cancellation of power of attorney: As the name suggest this form is issued for those persons who wishes to cancel his power of attorney that is granted to another person for enduring the power.
  • General power of attorney: With this form a person can grant the attorney or general power. This form is filled for the purpose of making an attorney if the person thinks that he is not capable of making decision at the present time or in the future.
  • Advance health directives: This form is for health purposes for those persons who wish to give the authority for giving medical directions by the authorized person due the person 's inability to speak for him.
  • Benefits and threats

    This provision can be a boon or a bane that solely depends upon the person to whom the authorization is given. The main benefit of this provision is that, due to this the legal or financial decision is not hampered and can avoid losses. However, if the person authorized makes a wrong or selfish decision then it becomes the responsibility of the owner. Hence, the power of attorney should be given to a trusted person and constant checks on the decision must be taken to catch nay misdeeds at that point itself.
